The Biggest Change to Scottish Tenancies for 26 years

The Scottish Government has opened a consultation period to outline a proposed new type of tenancy for Private Landlords.

The Government proposes to abolish the current Short Assured Tenancy and create a new type of tenancy which aims to ‘improve security of tenure for tenants, while providing appropriate safeguards for landlords, lenders and investors.’

The main changes proposed include:

  • longer notice periods for landlords and tenants
  • the abolition of ‘no fault’ termination of tenancies
  • a reduction in the ‘Grounds for Possession’
  • the removal of ‘monthly roll-over clauses’
  • the creation of a new Model Tenancy Agreement which would mean that the
  • Tenant Information Pack would no longer be required.
